1. Acceptance of these terms
These Terms of Use (the “Terms”) govern your access to and use of the Mathzle website and the Mathzle app that runs in the browser (together, the “Service”).
When the App provides a consent step, you accept these Terms by ticking the box at that step (see section 5 of the Privacy Policy). If you do not agree with these Terms, please do not create an account or use the Service.
When you accept these Terms in order to create a profile for your child, you accept them on your child’s behalf as their parent or guardian, and you are responsible for your child’s use of the Service.
2. Definitions
- “Mathzle”, “we”, “us”: the provider of the Service, whose details appear under Operator details.
- “You”, “parent”: a person aged 18 or over who is a child’s parent or legal guardian and who creates and manages the family account.
- “Child”: a child who uses the Service through a profile created by a parent.
- “Family account”: a parent’s account together with its child profiles and any co-parents invited to it.
- “Content”: the lessons, questions, games, images, characters, sounds, videos, text and software in the Service.
- “Beta”: the period in which Mathzle is offered free of charge for testing, as described in section 4.
3. Who may use the Service and accounts
- Parents create accounts. Only a person aged 18 or over with full legal capacity who is a child’s parent or legal guardian may create a family account and child profiles. Children do not create accounts themselves.
- Google sign-in. You currently sign in with a Google account. Your use of your Google account is also subject to Google’s Terms of Service.
- Your child’s profile. You can create a profile for your child with a nickname, age, avatar and PIN. We recommend a nickname and a built-in avatar rather than your child’s real name or photo.
- Supervision. You are responsible for supervising your child’s use of the Service, including age-appropriate screen time.
- Accurate information and account security. You provide accurate information, keep your Google account and your child’s PIN safe, and tell us promptly if you notice unauthorised use of your account. You are responsible for activity in your family account, except where it results from our fault.
- Co-parents. When you invite someone to co-manage your family account, they can see the profiles and learning progress of the children in the family. Only invite people you trust who have the right to care for your child.
4. Beta phase
Mathzle is currently in beta. During the beta:
- It’s free. The Service is provided free of charge. We do not ask for payment details.
- Features may change. Features, content and design may be added, changed, paused or discontinued. We will try to give notice of major changes that affect your child’s learning.
- Beta data. We aim to keep your child’s progress when we move to the public release, but we cannot guarantee that all beta data will carry over intact. If data needs to be reset, we will tell you by email in advance.
- Feedback. We would love to hear your feedback. When you send feedback, you allow us to use it to improve the Service without payment or attribution. We will not publish your or your child’s name or personal information with your feedback without your consent.
5. Acceptable use
You agree to use the Service for personal and family learning, and not to:
- use the Service in breach of Vietnamese law or public morals, or carry out acts prohibited by cybersecurity law;
- upload photos or content that is unlawful, infringes the rights of others, or is unsuitable for children;
- access or attempt to access other people’s accounts, profiles or data;
- reverse engineer, decompile, disassemble or attempt to extract the source code of the Service, except where the law allows;
- use robots, scrapers or other automated means to collect Content or data from the Service;
- interfere with, overload, spread malware through, or circumvent the security measures of the Service;
- copy, sell, rent out or commercially exploit the Content;
- impersonate anyone or give false information when creating an account.
6. Content and intellectual property
Mathzle and its licensors own all intellectual property rights in the Service and the Content, including names, trademarks, characters, illustrations, lessons and software, under intellectual property law.
We grant you and the members of your family account a limited, non-exclusive, non-transferable, revocable licence to use the Service and the Content for personal, non-commercial learning for as long as you comply with these Terms.
You keep your rights in photos and content you upload (for example, your child’s avatar photo). You allow us to store and display that content in the Service solely to provide the Service to your family. You confirm that you have the legal right to the content you upload.
7. Third-party content and services
Some parts of the Service rely on third-party services, for example:
- Google Sign-In for signing in;
- YouTube for playing lesson videos embedded in the App.
Your use of these services is also subject to the provider’s own terms and policies (for example the YouTube Terms of Service and the Google Privacy Policy). We choose videos that fit our lessons, but we do not control the YouTube platform and are not responsible for content outside the Service that users reach through those platforms. How we share data with third parties is described in our Privacy Policy.
8. Fees
During the beta, Mathzle charges no fees.
If Mathzle offers a paid plan in the future, we will:
- publish the price, what the plan includes and separate purchase terms (including how to cancel) before you buy, in line with the 2023 Law on Protection of Consumer Rights and e-commerce regulations;
- notify you before any paid plan applies;
- never move your account to a paid plan or charge you without your clear consent.
Children cannot make purchases in the Service.
9. Suspension and termination
By you. You can stop using the Service whenever you choose. To delete your family account or your child’s profile, please send a request as described in section 10 of our Privacy Policy; data is handled within the periods in section 8 of that Policy.
By us. We may suspend or terminate an account’s access if:
- the account seriously or repeatedly breaches these Terms;
- it is necessary to protect children, other users or the security of the Service;
- a competent authority requires it.
Except in an emergency or where the law does not allow it, we will email you the reason and give you a chance to respond before terminating.
Discontinuing the Service. If we stop providing the Service, we will give at least 30 days’ notice so that you can ask for a copy of your child’s learning data.
The sections on intellectual property, limitation of liability, dispute resolution and governing law survive the termination of these Terms.
10. Disclaimer of warranties
During the beta, the Service is provided free of charge on an “as is” and “as available” basis. To the extent the law allows, we do not guarantee that the Service will always be uninterrupted or error-free, or that it will meet every particular purpose you have. The Content is designed to support learning; it does not replace school or a teacher’s guidance.
This disclaimer does not reduce or exclude any consumer rights that the 2023 Law on Protection of Consumer Rights or other laws do not allow to be reduced, including the right to accurate and complete information about the Service and the right to protection of personal information.
11. Limitation of liability
To the extent the law allows, we are not liable for:
- indirect loss, such as lost opportunity or profit, arising from using or being unable to use the free Service;
- interruptions caused by force majeure, or by failures of the internet, infrastructure providers or your devices beyond our reasonable control;
- loss arising from your breach of these Terms or failure to keep your account secure.
These Terms do not exclude or limit our liability where the law does not allow it to be excluded or limited, including liability for our fault causing harm to a consumer’s life, health or property, liability for breaches of personal data protection rules, and your rights as a consumer under the 2023 Law on Protection of Consumer Rights.
12. Complaints and dispute resolution
Complaints. You can send complaints or feedback about the Service through the contact channel in section 15. We acknowledge receipt within 72 hours and respond with the outcome within 30 days at most, unless the law sets a shorter period.
Ways to resolve disputes. Under the 2023 Law on Protection of Consumer Rights, disputes between you and us may be resolved by:
- Negotiation directly between you and us — always our first choice;
- Mediation through a mediation organisation or a social organisation that protects consumer rights;
- Arbitration, if both parties have a valid arbitration agreement. For individual consumers, an arbitration agreement applies only if you agree to it when the dispute arises;
- A competent court in Vietnam.
Choosing negotiation or mediation does not take away your right to go to court or to ask the competent consumer protection authority to resolve the matter.
13. Governing law
These Terms are governed by and interpreted under the laws of Vietnam. If any provision is held invalid by a competent authority, the remaining provisions stay in effect.
These Terms are made in Vietnamese and English. If the two versions differ, the Vietnamese version prevails.
14. Changes to these terms and notices
We may update these Terms when the Service or the law changes. The new version is posted on this page with its update date.
For material changes that affect your rights or obligations, we will notify you by email or in the App at least 15 days before the change takes effect, and ask you to accept the new Terms through an explicit action in the App; we do not treat merely continuing to use the Service as acceptance. If you do not agree, you can stop using the Service and ask us to delete your data.
We send notices to your family account’s email address or show them in the App. Please keep that email address active.
15. Contact
If you have questions about these Terms or want to make a complaint, please contact us through our Contact page or the channel under Operator details.
